Creed

Under the Ontario Human Rights Code, discrimination because of creed is against the law. Everyone should have access to the same opportunities and benefits, and be treated with equal dignity and respect, regardless of their creed.

The Code does not define creed, but the courts and tribunals have often referred to religious beliefs and practices. Creed may also include non-religious belief systems that, like religion, substantially influence a person’s identity, worldview and way of life. People who follow a creed, and people who do not, have the right to live in a society that respects pluralism and human rights and the right to follow different creeds.

  1. Opinion editorial "Class of rights"

    October 26, 2007 - The values embodied in human rights laws hold a special place in the minds of Canadians. Canadians believe that tolerance, mutual respect, and diversity are fundamental to the nature and success of this country. Looking at some of the recent debate in Ontario around religious school funding, and the ongoing consultation in Quebec on reasonable accommodation, I believe that this is a time to remember and promote those values. It is certainly not time to turn away from them.
  2. Submission of the Ontario Human Rights Commission to the College of Physicians and Surgeons of Ontario Regarding the draft policy, "Physicians and the Ontario Human Rights Code"

    February 2008 - The draft policy raises a number of new concerns. The following pages detail the Commission’s concerns and provide suggestions for how to address them. We hope that our comments assist the College in providing greater clarity and ensuring that physicians have correct and sufficient information about their obligations under the Code.
  3. Commission statement concerning issues raised by complaints against Maclean's Magazine

    April 9, 2008

    In a recent decision, the Ontario Human Rights Commission (the “Commission”) decided not to proceed with complaints filed against Maclean’s magazine related to an article “The future belongs to Islam”. The complainants alleged that the content of the magazine and Maclean’s refusal to provide space for a rebuttal violated their human rights.

  4. Tribunal rules on employee lifestyle and morality statement

    April 25, 2008

    Toronto, Ontario – The Human Rights Tribunal of Ontario released its decision in the case of Connie Heintz v. Christian Horizons. The decision has a significant impact for faith-based and other organizations that provide services to the general public. Such organizations must ensure their hiring policies and practices do not unreasonably restrict or exclude the employment of persons based on grounds under the Ontario Human Rights Code.

  5. Human Rights system changes take effect

    June 30, 2008

    Toronto - The Human Rights Code Amendment Act, 2006, S.O. 2006, c. 30 is now in effect. As a result, the Ontario Human Rights Commission will no longer accept complaints of discrimination. All new applications alleging discrimination are to be filed with the Human Rights Tribunal of Ontario (HRTO). Complaints that were filed with the Commission before June 30, 2008 can be changed to applications to the HRTO if the Complainant takes an active step to do so.
