Disability

The Code protects people from discrimination and harassment because of past, present and perceived disabilities.  “Disability” covers a broad range and degree of conditions, some visible and some not visible. A disability may have been present from birth, caused by an accident, or developed over time.

There are physical, mental and learning disabilities, mental disorders, hearing or vision disabilities, epilepsy, mental health disabilities and addictions, environmental sensitivities, and other conditions.

  1. Human Rights Commission settles claim with respect to the exhibition of closed captioned movies

    July 24, 2007

    Toronto, Ontario - The Ontario Human Rights Commission today announced a settlement in the complaints between Nancy Barker, Gary Malkowski and Scott Simser, and movie exhibitors Alliance Atlantis Cinemas partnership, AMC Entertainment International Inc., Cineplex Entertainment LP and Rainbow Centre Cinemas Inc.

  2. Human rights commissions and economic and social rights

    2001 - This paper is one of several initiatives by the Ontario Human Rights Commission to explore ways in which human rights commissions can become more involved in protecting and promoting economic and social rights and in implementing international treaties to which Canada is a party. The challenge for human rights commissions is to find ways to maximize the potential of their mandates to promote international standards, including those contained in the International Covenant on Economic, Social and Cultural Rights.
  3. Human Rights Complaints settled against the Ministry of transportation, City of Hamilton and DARTS

    November 25, 2004

    Toronto - A settlement has been reached between two Complainants with disabilities, the Ministry of Transportation, the City of Hamilton, and the Disabled and Aged Regional Transit System(“DARTS”), a transit service for persons with disabilities provided by the City of Hamilton.

  4. Human Rights settlement reached with Ministry of Education on Safe Schools - Terms of settlement

    WHEREAS on July 7, 2005, the OHRC initiated a complaint, number GKEA-6DUH6W, pursuant to subsection 32(2) of the Human Rights Code in the public interest and on behalf of racialized students and students with disabilities alleging that the application of the safe schools provisions of the Education Act and the Ministry’s and school boards’ policies on discipline are having a disproportionate impact on racial minority students and students with disabilities. NOW THEREFORE, the Parties agree to settle these matters as follows:

  5. Human Rights Settlement Wins Hotel Visual Fire Alarms for Deaf and Hard of Hearing Guests

    January 30, 2008

    Toronto - The Ontario Human Rights Commission has reached a settlement between the Days Hotel and Conference Centre, Toronto Airport East and hotel guest Barbara Dodd. The settlement will see the establishment of new fire safety practices for the hotel and sets a positive example for the use of visual strobe light fire alarms for deaf, deafened and hard of hearing individuals in Ontario hotel accommodations as an important practice to be followed by the hospitality industry province-wide.

  6. Human Rights system changes take effect

    June 30, 2008

    Toronto - The Human Rights Code Amendment Act, 2006, S.O. 2006, c. 30 is now in effect. As a result, the Ontario Human Rights Commission will no longer accept complaints of discrimination. All new applications alleging discrimination are to be filed with the Human Rights Tribunal of Ontario (HRTO). Complaints that were filed with the Commission before June 30, 2008 can be changed to applications to the HRTO if the Complainant takes an active step to do so.
