    International, federal and provincial human rights legislation prohibit discrimination against persons with mental health disabilities.[3] In Ontario, human rights protections for people with mental health disabilities and addictions are grounded in the Ontario Human Rights Code. People with mental health issues are covered under the ground of “disability” in the Code.

    The exemption from the prohibition of employment discrimination (section 24(1)(a) of the Human Rights Code) is a concern for religious communities; narrow interpretation results in undue infringement of the right to freely associate with others in a religious community.

  3. Policy on accessible education for students with disabilities


    The Ontario Human Rights Code  recognizes the importance of creating a climate of understanding and mutual respect for the dignity and worth of each person, so that each person can contribute fully to the development and well-being of the community and the Province. The Code guarantees the right to equal treatment in education, without discrimination on the ground of disability, as part of the protection for equal treatment in services.

    This Policy replaces the Guidelines on accessible education (2004).
