  1. Creed and human rights for Indigenous peoples

    What protection does the Ontario Human Rights Code offer?

    The Ontario Human Rights Code (the Code) recognizes the dignity and worth of every person in Ontario. It provides for equal rights and opportunities, and freedom from discrimination. Indigenous peoples, including status, non-status, First Nations, Métis and Inuit peoples, are included in these protections.

    The Code prohibits discrimination and harassment based on 17 personal attributes – called grounds. Creed is one of the protected grounds.

    The Supreme Court of Canada has recognized that pregnancy cannot be separated from sex. It stated, “Discrimination on the basis of pregnancy is a form of sex discrimination because of the basic biological fact that only women have the capacity to become pregnant.”[8] Section 10(2) of the Code states that, “The right to equal treatment without discrimination because of sex includes the right to equal treatment without discrimination because a woman is or may become pregnant.”

    Certains employeurs de l'Ontario exigent que leurs employées portent des vêtements sexualisés ou s'habillent d'une façon conforme à leur sexe au lieu de travail, notamment en exigeant qu'elles portent des hauts talons, des jupes courtes, des vêtements plaqués ou des décolletés plongeants. Ce genre de codes vestimentaires renforce les stéréotypes et les notions sexistes sur l'allure des femmes et pourrait être contraire au Code des droits de la personne de l'Ontario (le Code).

    The Ontario Human Rights Commission (OHRC) is an arm’s-length agency of the government of Ontario established under the Ontario’s Human Rights Code. The function of the OHRC is to protect, promote and advance respect for human rights in Ontario, as well as identify and promote the elimination of discriminatory practices, all in the public interest. The OHRC works in many different ways to fulfill this mandate, including through education, policy development, public inquiries and litigation.

    2012 - Ang Alintuntunin ng mga Karapatang Pantao sa Ontario [Ontario Human Rights Code] (ang Alintuntunin) ay nagbibigay ng patas na karapatan at opportunidad, at kalayaan mula sa diskriminasyon.
