1. Letter to TCDSB on including gender identity, gender expression, family status and marital status in the TCDSB’s Code of Conduct

   The OHRC is aware that the Toronto Catholic District School Board (TCDSB) is considering amending its Code of Conduct to specifically include gender identity, gender expression, family status and marital status as grounds upon which members of the TCDSB community cannot be treated unfairly. Our understanding is that this issue is being specifically considered by the Catholic Education and Living our Catholic Values Sub-committee on September 25, 2019.

2. The Ontario Human Rights Code

   Ontario's Human Rights Code, the first in Canada, was enacted in 1962. 

   The Code prohibits actions that discriminate against people based on a protected ground  in a protected social area.

3. Family status and the Ontario Human Rights Code (fact sheet)

   2007 - The Ontario Human Rights Commission has interpreted the ground of family status as protecting a range of families and familial relationships from discrimination. It protects parents from being discriminated against because they have children; it also protects adult children who experience discrimination because they are caring for their aging parents. It protects non-biological parent and child relationships, such as those formed through adoption, fostering, and step-parenting, as well as lone parent families, and those headed by LGBT persons.

   Le Code des droits de la personne de l'Ontario, le premier au Canada, a été adopté en 1962. Le Code interdit les actions qui constituent de la discrimination contre certaines personnes en fonction de l’un des motifs les protégeant dans un secteur social protégé.

5. OHRC statement on Code obligations of education officials

   The OHRC is aware and concerned about the increasing violence targeted at education officials for doing human rights work, adhering to the obligations set under the Ontario Human Rights Code (Code) and implementing government policy.

   La Commission ontarienne des droits de la personne (la « Commission ») est un organisme indépendant du gouvernement provincial. Le plus ancien organisme de ce genre au Canada, la Commission a été établie en 1961 dans le but de protéger, de promouvoir et de faire progresser le respect des droits de la personne en Ontario, conformément au Code des droits de la personne de l’Ontario (le « Code »). La Commission a de vastes fonctions et pouvoirs qui lui sont conférés par le Code et elle agit de manière indépendante dans l’intérêt du public.

   There are six sections in the Code that have implications for the insurance industry (see Appendix). Section 3 prohibits discrimination in contracts, which would therefore prohibit discrimination in insurance contracts.

8. The Commission and the Human Rights Code

   The Ontario Human Rights Commission (the “Commission”) is an independent, arm's length agency of the provincial government. Canada’s oldest commission, it was established in 1961 to protect, promote, and advance human rights, as set out in Ontario’s Human Rights Code (the “Code”). The Commission has broad functions and powers under the Code and acts independently on behalf of the public interest.

9. L’état familial et le Code des droits de la personne de l’Ontario (fiche)

   2007 - La Commission ontarienne des droits de la personne a interprété le motif de l’état familial comme un moyen de protéger toute une gamme de familles et de relations familiales contre la discrimination. Le motif protège les parents contre la discrimination fondée sur le fait qu’ils ont des enfants; il protège également les enfants adultes qui sont victimes de discrimination parce qu’ils s’occupent de leurs parents vieillissants. Par ailleurs, le motif protège les relations entre enfants et parents non biologiques comme celles qui sont le résultat de l’adoption, de l’accueil et des familles reconstituées, ainsi que les familles monoparentales et celles dirigées par des personnes LGBT.

10. Dispositions liée à l’assurance dans le Code

    Six articles du Code ont des répercussions sur l’industrie des assurances (voir annexe). L’article 3 interdit la discrimination dans tout contrat, notamment dans les contrats d’assurance.
