    a) Employers

    Employers have the primary obligation to make sure their workplace is free from discrimination and harassment. Employers are expected to proactively provide a workplace where human rights are respected and employees afforded equal opportunities. This includes working with unions to negotiate collective agreements that are consistent with the Code.

  3. OHRC submission to Ministry of Labour Changing workplace review

    September 18, 2015 - The Ontario government is consulting on the changing nature of the modern workplace and considering how the Employment Standards Act and the Labour Relations Act could be amended to best protect workers, especially historically under-represented groups. The Ontario Human Rights Commission (OHRC) makes this submission in accordance with its mandate to promote and advance human rights under Ontario’s Human Rights Code.

  4. IV. Human rights issues at all stages in employment

    The right to “equal treatment with respect to employment” protects persons in all aspects of employment, including applying for a job, recruitment, training, transfers, promotions, terms of apprenticeship, dismissals, layoffs and terminations. It also covers rate of pay, codes of conduct, overtime, hours of work, holidays, benefits, shift work, performance evaluations and discipline. A fundamental starting point for complying with the Code in relation to all of these is to have a workplace setting where human rights are respected and applied.

  5. RE: Proposed North Bay Rental Housing Licensing By-law

    June 28, 2011 - Over the past two years, the Ontario Human Rights Commission (OHRC) has monitored and reviewed rental housing licensing bylaws in various municipalities. Rental housing licensing is a relatively new option for municipalities, and our goal has been to make sure that these bylaws, even unintentionally, do not create barriers and discrimination in housing for vulnerable people who are protected under the grounds of the Ontario Human Rights Code (the Code).
  6. 4. What are competing rights?

    In general, competing human rights involve situations where parties to a dispute claim that the enjoyment of an individual or group’s human rights and freedoms, as protected by law, would interfere with another’s rights and freedoms. This complicates the normal approach to resolving a human rights dispute where only one side claims a human rights violation. In some cases, only one party is making a human rights claim, but the claim conflicts with the legal entitlements of another party or parties.

    Mars 2004 - Le présent mémoire a été rédigé en réponse à la consultation publique du Ministère des Affaires civiques et de l’Immigration sur le renforcement de la Loi sur les personnes handicapées de l’Ontario (LPHO). La Commission ontarienne des droits de la personne (CODP) félicite le Ministère de cette initiative visant à renforcer la LPHO et à la rendre plus efficace. Nous croyons qu’une LPHO solide peut mener à une amélioration importante des conditions de vie des personnes handicapées en Ontario.
